F & H Wilson Trading as Osmonds – Terms and Conditions of Sale

Please read all terms and conditions carefully.

These Terms and Conditions apply to the purchase of goods by you (the Customer or you). We are F & H Wilson Trading as Osmonds, whose registered office is at Bradeley Green, Tarporley Road, Whitchurch, Shropshire, SY13 4HD, email info@osmonds.co.uk, telephone 01948 668100 (the Supplier, us or we). By ordering any of the goods, you agree to be bound by these Terms and Conditions. You can only purchase goods from the website if you are eligible to enter into a contract and are at least 18 years old. These Terms and Conditions also apply to Trade Customers buying goods with the intention of selling to their consumers.

The description of the goods is as set out on the website, in catalogues, brochures or other advertisements, for illustrative purposes only; there may be small discrepancies in size and colour. All goods are subject to availability, and we may make changes necessary to comply with any applicable law or safety requirement, notifying you of these changes.

We retain and use all information strictly under our Privacy Policy. We may contact you by email, other electronic communication, or pre-paid post, and by placing an order you expressly agree to this.

The description of goods on our website does not constitute a contractual offer to sell. We may reject an order for any reason and will try to tell you why without delay. A Contract is formed only when you receive an Order Confirmation email from us. Any quotation is valid for a maximum of 14 days from its date unless withdrawn earlier. No variation of the Contract can be made after it is entered into unless agreed in writing by both parties.

The price of the goods and any delivery charges are as set out on the website at the date of order, or as otherwise agreed in writing, and include VAT where applicable. Payment is taken by credit or debit card, generally at the time of, or before, delivery of the goods, unless another arrangement has been agreed with Osmonds.

We will deliver the goods within the agreed period or, failing agreement, without undue delay and in any event no later than 30 days after the Contract is entered into. If we fail to deliver on time you may, in certain circumstances, treat the Contract as at an end and we will promptly refund all payments made. We may deliver goods in instalments where reasonable, and risk in the goods passes to you on delivery.

Risk of damage to or loss of goods passes to you on delivery. You do not own the goods until we have received payment in full.

You can withdraw your order by telling us before the Contract is made, without giving a reason and without liability. This is a distance contract with a 14-day cancellation right (subject to certain exclusions, such as goods made to your specification or which are liable to deteriorate rapidly).

Right to cancel: you can cancel within 14 days of receiving the last of the goods, without giving any reason. To cancel, contact us by a clear statement (letter, email, or via our contact form) – we will acknowledge your cancellation without delay.

Effects of cancellation: we will reimburse all payments received from you, including standard delivery costs, without undue delay (normally within 14 days of receiving the goods back, or of you providing evidence you've sent them). We may deduct an amount for any loss in value caused by unnecessary handling of the goods.

Returning goods: you must send back or hand over the goods to us at Bradeley Green, Tarporley Road, Whitchurch, Shropshire, SY13 4HD without delay and within 14 days of telling us you wish to cancel. You are responsible for the cost of returning the goods.

We have a legal duty to supply goods that conform to the Contract: of satisfactory quality, fit for any particular purpose made known to us, and matching their description.

Neither party is liable for failure to perform obligations due to circumstances beyond its reasonable control, though this does not affect your rights relating to delivery or cancellation.

All website content, unless supplied by a third party, is and remains the property of Osmonds. You may not use, copy, reproduce or distribute materials from the website without our prior written permission. Content supplied by third parties remains the property of the relevant supplier/manufacturer.

We take all reasonable steps to keep the website accurate, secure and free from viruses or errors, but make no warranties to that effect. We do not exclude liability for fraud, or for death or personal injury caused by our negligence or breach of legal obligations; subject to this, we are not liable for losses that were not reasonably foreseeable, or for business losses where you are not buying as a consumer.

This Contract is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any disputes. If you have a complaint, please contact us and we will aim to respond with an appropriate solution within 14 days.
